1. Acceptance
By creating an account, buying a plan or using the website or workspace, you agree to these terms, the Privacy Policy, the Cookie Policy and the Refund Policy. If you use ThumbsGen for a company or client, you confirm you can bind that organisation. If you do not agree, do not use the service.
2. The service
ThumbsGen is an AI-assisted tool that generates and lets you edit YouTube thumbnail drafts. Exports are 1280×720 px (16:9), JPG or PNG. The service changes over time: we may add, change or remove features. Features marked “coming soon” are not part of the service yet and are not promised for any date. The demo workspace uses sample data and does not save anything.
3. Accounts
- You must be at least 18, or the age of majority where you live, and able to enter a binding contract.
- Give accurate information and keep it up to date.
- Keep your password secure. You are responsible for all activity under your account, and must tell us promptly at support@thumbsgen.com if you suspect unauthorised use.
- One account per person unless your plan states otherwise. Do not share logins in a way that avoids paying for more seats or plans.
4. Faces and uploads
You confirm that you own or have permission to use every image, face, logo, text and other material you upload, including any consent required from people who appear in it, for the purpose of generating and publishing thumbnails. You must not upload images of other people to impersonate or mislead. We may remove content and suspend accounts that breach this section. Uploads are kept for 30 days after upload unless you delete them sooner; see the Privacy Policy and Security page.
5. Credits
1 credit = 1 generated variant set of 3 thumbnails. Plans include a monthly number of credits as shown on the pricing page. Editing, re-exporting and comparing existing thumbnails does not use credits. Credits are used when a generation completes. If a generation fails because of a fault on our side, the credit is returned. Rollover rules are shown per plan, unused credits that do not roll over expire at the end of the period, and credits have no cash value and cannot be transferred.
6. Subscriptions and billing
- Paid plans are billed in advance, monthly or annually, in the currency shown at checkout. Annual billing, where offered, is shown with its own price.
- Payments are processed by Stripe. You authorise us and Stripe to charge your chosen payment method at the start of every period until you cancel.
- Plans renew automatically. We will tell you in advance if the price of your plan changes, and the new price applies from your next renewal.
- Prices may exclude taxes. Where required, VAT or sales tax is added at checkout.
- If a payment fails, we may retry it, restrict credit use and suspend the account until payment is made.
- You are responsible for chargebacks that are made in error. Please contact us first so we can fix a billing problem quickly.
Nothing in these terms limits any statutory right of withdrawal or other consumer right you have. For digital services that begin immediately, by completing your purchase you ask us to start the digital service immediately and acknowledge that, once credits are used or the service is fully delivered, your statutory right of withdrawal may be lost where the law allows.
7. Cancellation
You can cancel at any time from the billing portal or by writing to support@thumbsgen.com. Cancellation takes effect at the end of the billing period already paid, you keep access until then, and no further charges are made. We do not give prorated refunds for unused time except as set out in the Refund Policy or where the law requires.
8. Acceptable use
You agree not to:
- upload or create unlawful content, or content that infringes others' copyright, trademark, privacy or publicity rights;
- create deceptive, hateful, violent, sexual, harassing or exploitative material, or any content involving minors in a sexual or unsafe context;
- impersonate a real person or organisation without their permission, or make thumbnails designed to mislead viewers about who made a video;
- attempt to break, probe, overload or reverse-engineer the service, or bypass credit limits, rate limits or access controls;
- scrape, copy or resell the service or its outputs in bulk as a competing product, or resell access without our written agreement;
- use the service to build or train a competing image-generation model;
- upload malware or content that could harm the service or other users;
- break YouTube's Terms of Service, Community Guidelines or thumbnail policies in the material you publish.
We may investigate suspected breaches and remove content, limit features or suspend accounts. Where required by law, we may report illegal content to the authorities.
9. Your content and license to us
You keep ownership of the images, text and other material you upload or enter (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, process, reproduce and display Your Content only as needed to operate, secure and support the service for you, and, only if you have not opted out, to improve our models as described in the Privacy Policy. This license ends when you delete the content or close your account, subject to backup and legal retention periods.
10. Ownership of outputs
As between you and us, you own the thumbnails you export, provided you had the rights to the inputs you used. We keep all rights in the ThumbsGen software, templates and brand. Because outputs are AI-generated, similar outputs may be produced for other users, and we cannot guarantee that an output is eligible for copyright protection in your country. You are responsible for checking that you may publish the final thumbnail.
11. Our intellectual property
The ThumbsGen software, website, design, templates, name and logo belong to us or our licensors and are protected by law. We give you a limited, revocable, non-transferable license to use the service for your own channels and clients while your account is active. No other rights are granted. If you send feedback or suggestions, we may use them without obligation to you.
12. YouTube and third-party services
ThumbsGen is not affiliated with, endorsed by or sponsored by YouTube or Google. Features such as YouTube's Test & Compare depend on YouTube and may not be available on every channel. We use third-party providers (see the sub-processor list) and cannot control their availability or terms.
13. No performance guarantees
We do not promise any particular result. ThumbsGen does not guarantee views, click-through rate, watch time, revenue, subscribers or channel growth. Thumbnails are a starting point you review and edit, and results depend on many factors outside our control. Variants are provided so you can run your own tests.
14. Takedown requests
If you believe content created or stored through ThumbsGen infringes your rights or shows you without permission, email support@thumbsgen.com with your contact details, a description of the content and where it is, why you believe it is infringing, and a statement that your report is accurate. We will review it, may remove the content, and may notify the account holder. Repeat infringers may lose access.
15. Suspension and termination
You may stop using the service or close your account at any time. We may suspend or end access, with notice where reasonable, if you breach these terms, if payment is overdue, if required by law, or if continuing would create risk for us or others. On termination your right to use the service ends, and we will delete or anonymise your data as described in the Privacy Policy. Sections that by their nature should survive (ownership, disclaimers, liability, disputes) continue after termination.
16. Disclaimers
To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. AI outputs can be inaccurate, unexpected or unsuitable, and you are responsible for reviewing them before use. Consumer rights that cannot be excluded by law are not affected.
17. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data, goodwill or channel performance. Our total liability for claims relating to the service is limited to the amount you paid us in the 12 months before the claim. None of this excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud, or your statutory consumer rights.
18. Indemnity
If you use the service for business purposes, you agree to cover reasonable losses we suffer from third-party claims caused by Your Content or your breach of these terms, for example a claim that an uploaded photo was used without permission. This does not apply to consumers where the law does not allow it.
19. Governing law and disputes
These terms are governed by the laws of [GOVERNING LAW / JURISDICTION, PLACEHOLDER]. Please contact us first so we can try to resolve a problem informally. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and any right to bring a claim in your local courts.
20. General
- Entire agreement: these terms and the policies they refer to are the whole agreement between us about the service.
- Severability: if a part is found unenforceable, the rest stays in force.
- No waiver: not enforcing a right now does not give it up later.
- Assignment: you may not transfer your account or rights without our consent. We may transfer ours in a merger or sale.
- Force majeure: neither side is liable for delays caused by events outside reasonable control, such as outages of internet or cloud providers.
- Notices: we may notify you by email, in the product or on this page.
- Language: the English version prevails if translated.
21. Changes and contact
We may update these terms. We will post the new version and change the date above, and give notice of material changes by email or in the product before they apply. Continuing to use ThumbsGen after the effective date means you accept the update. If you do not, you can cancel before it takes effect. Questions: support@thumbsgen.com, or see the contact page.
